Passenger slammed as he takes "manspreading to ANOTHER LEVEL"

Mariah Carey slapped with multi-million dollar lawsuit over hit festive song

<p dir="ltr">Mariah Carey is facing a multi-million dollar lawsuit over her hit festive song, as another musician has come forward claiming she plagiarised an original work.</p> <p dir="ltr">Carey’s song <em>All I Want For Christmas Is You</em> has long been a staple of December, and has sold over 10 million copies since its 1994 release. </p> <p dir="ltr">However, Andy Stone, lead vocalist of Vince Vance and the Valiants, claims Carey infringed on his copyright. </p> <p dir="ltr">Stone co-wrote a song, which has the same title as Carey’s smash hit, in 1989 to which he claims Carey and her team of copying his song’s “compositional structure,” according to the complaint obtained by <a href="https://www.foxnews.com/entertainment/mariah-carey-facing-20-million-lawsuit-over-all-i-want-for-christmas-is-you" target="_blank" rel="noopener">Fox News Digital</a>.</p> <p><iframe title="YouTube video player" src="https://www.youtube.com/embed/w8HWHd0EYJA?si=IdW0GIKXEQBJqaO_" width="560" height="315" frameborder="0" allowfullscreen="allowfullscreen"></iframe></p> <p dir="ltr">The court documents state that Carey “directly” copied lyrics from Stone’s 1989 hit and “approximately 50 per cent” of the song is copyright infringement.</p> <p dir="ltr">Stone went on to claim that Carey and her team “undoubtedly” had access to his version of <em>All I Want For Christmas is You</em> due to its “wide commercial and cultural success.”</p> <p dir="ltr">Stone’s track charted on Billboard for years, with the band even performing the track at the White House in 1994 - the same year Carey’s festive song was released. </p> <p dir="ltr">“Carey has capitalised on the success of her infringing work,” Stone’s complaint alleged. </p> <p><iframe title="YouTube video player" src="https://www.youtube.com/embed/yXQViqx6GMY?si=Exrq9M0AA2u5XRpB" width="560" height="315" frameborder="0" allowfullscreen="allowfullscreen"></iframe></p> <p dir="ltr">“<em>All I Want For Christmas is You</em> has become a ubiquitous part of popular culture, and Carey’s name has become synonymous with the season.”</p> <p dir="ltr">Stone first sued Carey over the copyright issue in June 2022 in a Louisiana court before dropping the claim five months later. </p> <p dir="ltr"><em>Image credits: Getty Images</em></p>

Should I be getting my vitamin D levels checked?

<p><em><a href="https://theconversation.com/profiles/elina-hypponen-108811">Elina Hypponen</a>, <a href="https://theconversation.com/institutions/university-of-south-australia-1180">University of South Australia</a></em></p> <p>Australia has seen a <a href="https://insightplus.mja.com.au/2023/29/gps-urged-not-to-routinely-test-children-for-vitamin-d/">surge in vitamin D testing</a> of children, with similar trends reported for adults around the <a href="https://pubmed.ncbi.nlm.nih.gov/29659534/">world</a>. GPs are now <a href="https://insightplus.mja.com.au/2023/29/gps-urged-not-to-routinely-test-children-for-vitamin-d/">being urged</a> not to test for vitamin D unnecessarily.</p> <p>So when is low vitamin D a potential concern? And when might you need to get your levels tested?</p> <h2>How much vitamin D do we need?</h2> <p>Vitamin D is not only a nutrient – when metabolised in the body it acts as a <a href="https://pubmed.ncbi.nlm.nih.gov/29080638/">hormone</a>. We have receptors for this hormone all around our body and it helps regulate the metabolism of calcium and phosphorus.</p> <p>Vitamin D also has many other roles, including helping our immune defences and contributing to <a href="https://pubmed.ncbi.nlm.nih.gov/11295155/">DNA repair</a> and cell differentiation.</p> <p>We can thank the sun for most of our vitamin D. A chemical in our skin called 7-dehydrocholesterol is converted to vitamin D after contact with UVB radiation from the sun.</p> <p>While we get some vitamin D also <a href="https://pubmed.ncbi.nlm.nih.gov/35253289/">through our diet</a>, this makes a relatively small contribution. It’s difficult to get much more than one-third of our daily vitamin D requirement from diet without supplementation.</p> <p>Nutritional vitamin D status is <a href="https://en.wikipedia.org/wiki/Calcifediol">typically measured</a> via a blood test. This checks the calcidiol (calcifediol, 25-hydroxyvitamin D) concentrations, which reflect the average intakes from the sun and diet over the past three to four weeks.</p> <p>The <a href="https://pubmed.ncbi.nlm.nih.gov/22708765/">current recommendation</a> is that we should all aim to have at least 50nmol/L (20ng/mL) at the end of winter.</p> <p>However, one problem with vitamin D tests is that there is <a href="https://pubmed.ncbi.nlm.nih.gov/37182753/">variation</a> in measured concentrations between the laboratories and between the assays, and whether you’re deemed to have a deficiency can depend on the testing method used.</p> <p>Doctors do not always agree with what is deficiency. While very low concentrations are likely to prompt doctors to recommend a supplement (and, potentially, follow-up testing), some may consider even relatively high concentrations as inadequate.</p> <p>This is all understandable as research in this space is still evolving, and we know low concentrations do not always cause any symptoms.</p> <h2>Why avoid vitamin D deficiency?</h2> <p>Prolonged, severe vitamin D deficiency will lead to softening of bone tissue and cause diseases such as rickets (children) and osteomalacia (adults).</p> <p>However, avoiding low concentrations is likely to be good for <a href="https://pubmed.ncbi.nlm.nih.gov/37483080/">many aspects of health</a>, with consistent evidence suggesting benefits for <a href="https://www.bmj.com/content/356/bmj.i6583">infectious diseases</a> and autoimmune conditions such as multiple sclerosis.</p> <p>Randomised trials have also provided evidence for lower <a href="https://pubmed.ncbi.nlm.nih.gov/35676320/">cancer</a> and <a href="https://pubmed.ncbi.nlm.nih.gov/24414552/">all cause mortality</a> by daily supplementation, although any benefit is likely to be restricted to those who otherwise have insufficient intakes.</p> <h2>Who is at risk of deficiency?</h2> <p>Most of us do not need tests to have a relatively good idea whether we might be at risk of a clinically important deficiency.</p> <p>If it’s not late winter, we spend regularly at least some time outside with skin exposed to the sun, and we do not belong to a specific high-risk group, it is unlikely that our <a href="https://pubmed.ncbi.nlm.nih.gov/22168576/">levels would be very low</a>.</p> <p>The two main reasons for vitamin D deficiency typically relate to:</p> <p><strong>1. not getting (enough) vitamin D through sun exposure.</strong> Deficiency risk <a href="https://www.healthdirect.gov.au/vitamin-d-deficiency">can be high</a> for anyone who is housebound, such as older or disabled people in residential care. The risk of deficiency increases if we always cover our skin carefully by <a href="https://pubmed.ncbi.nlm.nih.gov/19211395/">modest cultural dress,</a> and also <a href="https://pubmed.ncbi.nlm.nih.gov/6119494/">dark skin pigmentation</a> is known to reduce vitamin D synthesis.</p> <p><strong>2. having a chronic disease that alters your requirement.</strong> Medications such as anticonvulsants used to treat epilepsy, and conditions such as <a href="https://my.clevelandclinic.org/health/diseases/15050-vitamin-d-vitamin-d-deficiency">liver and kidney diseases</a> can interfere with vitamin D metabolism. Some <a href="https://my.clevelandclinic.org/health/diseases/15050-vitamin-d-vitamin-d-deficiency">digestive diseases</a> can reduce vitamin D absorption from your diet, while <a href="https://pubmed.ncbi.nlm.nih.gov/30020507">obesity</a> will increase your vitamin D requirement and make it more difficult to raise your blood levels.</p> <h2>Am I getting enough sun exposure?</h2> <p>In Australia, it is possible to get enough vitamin D from the sun <a href="https://healthybonesaustralia.org.au/your-bone-health/vitamin-d-bone-health">throughout the year</a>. This isn’t so for many people living in the northern hemisphere.</p> <p>For those who live in the top half of Australia – and for all of us during summer – we <a href="https://healthybonesaustralia.org.au/your-bone-health/vitamin-d-bone-health">only need</a> to have skin exposed to the sun a few minutes on most days.</p> <p>The body can only produce a certain amount of vitamin D at the time, so staying in the sun any longer than needed is not going to help increase your vitamin D levels, while it will increase your risk of skin cancer.</p> <p>During winter, catching enough sun can be difficult, especially if you spend your days confined indoors. Typically, the required exposure increases to two to three hours per week in winter. This is because sunlight exposure can only help produce vitamin D if the UVB rays reach us at the correct angle. So in winter we should regularly spend time outside in the middle of the day to get our dose of vitamin D.</p> <p>If you are concerned, you have very dark skin, or are otherwise in a high-risk group, you may want to talk to your GP.</p> <p>In any case, taking a modest daily dose of vitamin D (1,000-2,000 IU) during the darker winter months is unlikely to cause harm and it <a href="https://pubmed.ncbi.nlm.nih.gov/37483080/">may be beneficial</a>.</p> <h2>Why does excess vitamin D testing matter?</h2> <p>When not indicated, testing can cause unnecessary worry and promote a cascade of <a href="https://pubmed.ncbi.nlm.nih.gov/32675268/">laboratory, prescription and imaging services</a> that are of low value.</p> <p>Excessive testing is also a waste of health-care resources, with one <a href="https://onlinelibrary.wiley.com/doi/full/10.5694/mja2.50619">single test</a> costing about the same as a years’ worth of vitamin D supplementation.</p> <p>Very often, we can make relatively small changes to our lifestyles to reduce the risks of vitamin D deficiency. <img style="border: none !important; box-shadow: none !important; margin: 0 !important; max-height: 1px !important; max-width: 1px !important; min-height: 1px !important; min-width: 1px !important; opacity: 0 !important; outline: none !important; padding: 0 !important;" src="https://counter.theconversation.com/content/211268/count.gif?distributor=republish-lightbox-basic" alt="The Conversation" width="1" height="1" /></p> <p><em><a href="https://theconversation.com/profiles/elina-hypponen-108811">Elina Hypponen</a>, Professor of Nutritional and Genetic Epidemiology, <a href="https://theconversation.com/institutions/university-of-south-australia-1180">University of South Australia</a></em></p> <p><em>Image credits: Getty Images</em></p> <p><em>This article is republished from <a href="https://theconversation.com">The Conversation</a> under a Creative Commons license. Don’t believe the hype. Menopausal women don’t all need to check – or increase – their testosterone levels

<p><em><a href="https://theconversation.com/profiles/susan-davis-10376">Susan Davis</a>, <a href="https://theconversation.com/institutions/monash-university-1065">Monash University</a></em></p> <p>Ever heard “low testosterone” blamed for low mood, brain fog and loss of vitality? Despite all evidence to the contrary, social media influencers are increasingly promoting testosterone therapy as an elixir for women experiencing troubling symptoms of menopause.</p> <p>In a series of documentaries and <a href="https://www.dailymail.co.uk/health/article-11792553/Davina-McCall-effect-sparks-menopause-testosterone-treatment-rush-putting-women-risk.html">social media posts</a> about menopause in 2021 and 2022, British TV presenter Davina McCall promoted the use of testosterone therapy in addition to standard <a href="https://www.menopause.org.au/hp/information-sheets/combined-menopausal-hormone-therapy-mht">menopausal hormone therapy</a>. The “<a href="https://www.telegraph.co.uk/news/2023/02/17/davina-effect-fuels-surge-menopausal-women-using-testosterone/#:%7E:text=Chelsea%20Magazine%20Company-,'Davina%20effect'%20fuels%20surge%20in%20menopausal%20women%20using%20testosterone,NHS%20prescriptions%20for%20the%20hormone">Davina effect</a>” has helped fuel a <a href="https://pharmaceutical-journal.com/article/news/nhs-testosterone-prescribing-in-women-rises-ten-fold-in-seven-years#:%7E:text=The%20number%20of%20women%20in,The%20Pharmaceutical%20Journal%20has%20revealed">ten-fold increase</a> in prescribing of testosterone for women in the United Kingdom since 2015.</p> <p>Data isn’t available for Australia, but in my clinical practice, women are increasingly asking to have their testosterone level checked, and seeking testosterone to treat fatigue and brain fog.</p> <p>But while testosterone continues to be an important hormone before and after menopause, this doesn’t mean women should be having a blood test to get their testosterone levels checked – or taking testosterone therapy.</p> <h2>What does testosterone do?</h2> <p>Testosterone is an important hormone in women’s bodies, affecting the blood vessels, skin, muscle and bone, breast tissue and the brain. In both women and men, testosterone can act on its own or be converted into estrogen.</p> <p>Before menopause, testosterone is made in the ovaries, where it helps developing eggs grow and aids in estrogen production.</p> <p>The ovaries release both testosterone and estrogen into the bloodstream, and the levels of the two hormones in the blood peak around ovulation.</p> <p>Some of the testosterone measured in blood is also produced outside the ovaries, such as in fat, where it is made from “pre-hormones” secreted by the adrenal glands. This source of production of testosterone takes over after menopause.</p> <h2>Do we have more testosterone before menopause?</h2> <p>The claim is often made that pre-menopausal women have more testosterone in their bloodstream than estrogen, to justify the need for testosterone replacement after menopause.</p> <p>But, when sex hormones have been measured with precision, studies have shown this is not true. <a href="https://pubmed.ncbi.nlm.nih.gov/31390028/">Our research</a> found estrogen levels are higher than testosterone levels at all stages of the menstrual cycle.</p> <p>Blood testosterone levels <a href="https://pubmed.ncbi.nlm.nih.gov/31390028/">fall</a> by about 25% between the ages of 18 and 40 years in healthy women. The fall in testosterone coincides with the decline in eggs in the ovaries but whether this is a marker of the decline, a consequence, or a cause of the decline is not known.</p> <p>From around 40, the rate of decline slows and blood testosterone levels don’t change when <a href="https://www.menopause.org.au/hp/information-sheets/what-is-menopause">menopause</a> occurs naturally. Studies have not shown testosterone levels change meaningfully during the menopause transition.</p> <h2>Can blood tests detect ‘low testosterone’?</h2> <p>Some influencers claim to have a condition called “testosterone deficiency syndrome” or low levels of testosterone detected in blood tests.</p> <p>But there is no “normal” blood level below which a woman can be diagnosed as having “testosterone deficiency”. So there’s no such thing as having a testosterone deficiency or testosterone deficiency syndrome.</p> <p>This is also in part, because women have very low testosterone concentrations compared with men, and most commercial methods used to measure testosterone cannot separate normal from low levels in women with any certainty.</p> <p>Pre-menopausal women might also be told they have “low” testosterone if blood is drawn early in the menstrual cycle when it is normal for testosterone to be low. (However, it would only be clinically necessary to do this type of blood test to look for <em>high</em> testosterone, in someone with with excessive hair growth or severe acne, for example, not for <em>low</em> testosterone.)</p> <p>In post-menopausal women, much of the action of testosterone occurs in the tissues where it is made, after which testosterone is either converted to estrogen or broken down before it leaks back into the circulation. So blood testosterone concentrations are not a true reflection of tissue concentrations.</p> <p>Further complicating the picture is the enormous variability in the effects of testosterone. At a given blood level of testosterone, some women might have oily skin, acne, increased body hair growth or balding, while others will have no such effects.</p> <p>So, looking for a “low” blood testosterone in women is not helpful.</p> <h2>Can testosterone improve sexual desire? What about other conditions?</h2> <p>There is sound evidence that testosterone therapy may improve sexual desire in post-menopausal women who have developed low sexual desire that bothers them.</p> <p>This was <a href="https://www.tandfonline.com/doi/full/10.1080/13697137.2019.1637079">confirmed by</a> a <a href="https://pubmed.ncbi.nlm.nih.gov/31353194/">systematic review</a> of clinical trials comparing testosterone with a placebo or an alternative. These trials, all of which involved a treatment time of at least 12 weeks, showed testosterone therapy, overall, improved desire, arousal, orgasm and sexual satisfaction in post-menopausal women with low desire that caused them distress.</p> <p>Treatment is only indicated for women who want an improvement in sexual desire (after excluding other factors such as depression or medication side effects) and its success can only be determined by each woman’s personal self-reported response.</p> <p>But there is <a href="https://www.tandfonline.com/doi/full/10.1080/13697137.2019.1637079">not enough evidence</a> to show testosterone is beneficial for any other symptom or medical condition. Is the Barbie movie a bold step to reinvent and fix past wrongs or a clever ploy to tap a new market?

<p><em><a href="https://theconversation.com/profiles/lauren-gurrieri-5402">Lauren Gurrieri</a>, <a href="https://theconversation.com/institutions/rmit-university-1063">RMIT University</a></em></p> <p>After a months-long marketing blitz, the much-hyped Barbie movie is released this week.</p> <p>From a <a href="https://news.airbnb.com/barbies-malibu-dreamhouse-is-back-on-airbnb-but-this-time-kens-hosting/">Malibu Barbie dreamhouse</a> listed on AirBnB, an AI tool that <a href="https://www.barbieselfie.ai/au/">transforms selfies into Barbie movie posters</a> and multiple Barbie-themed brand collaborations ranging from nail polish to roller skates, Barbie is everywhere.</p> <p>She has even gone viral as a fashion trend known as <a href="https://www.elle.com.au/fashion/barbiecore-27286">Barbiecore</a>, exploding across social media with people embracing vibrant pink hues and hyper feminine aesthetics. A Barbie world is upon us.</p> <p>Although some have criticised this <a href="https://twitter.com/MosheIsaacian/status/1673415496929267712">saturation</a> strategy, it is a very deliberate marketing ploy to revitalise and redefine a brand with a contested position and history.</p> <p>As well as attracting adults who grew up with Barbie and are curious to see what’s changed, the reinvention is drawing in those younger fans swept up by the tsunami of marketing and merchandise.</p> <p>Despite being one of the <a href="https://www.newsweek.com/brandspark-most-trusted-brands-america-2022">most trusted brands</a> with a value of approximately <a href="https://www.statista.com/statistics/1009126/barbie-brand-value-worldwide/">$US700 million</a>, Barbie has long attracted feminist criticism for fuelling outdated and problematic “plastic fantastic” sexist stereotypes and expectations.</p> <h2>The Barbie backlash</h2> <p>Only a few years back, Barbie was a brand in crisis. <a href="https://time.com/3667580/mattel-barbie-earnings-plus-size-body-image/">Sales plummeted</a> across 2011 to 2015 against the cultural backdrop of a rise in body positivity and backlash against a doll that represented narrow ideals and an impossible beauty standard.</p> <p>After all, at life-size Barbie represents a body shape held by <a href="https://link.springer.com/article/10.1007/BF01544300#page-1">less than 1 in 100,000</a> real people. In fact, she is so <a href="https://rehabs.com/explore/dying-to-be-barbie/#.UWs-5aKyB8F">anatomically impossible</a> that, if she were real, she would be unable to lift her head, store a full liver or intestines, or <a href="https://www.bmj.com/content/305/6868/1575">menstruate</a>.</p> <p>The backlash has also been in response to growing concerns about how she influences child development, particularly how and what children learn about gender. Barbie has been identified as a <a href="https://www.sciencedirect.com/science/article/pii/S1740144521000243#!">risk factor</a> for thin-ideal internalisation and body dissatisfaction for young girls, encouraging <a href="https://www.sciencedirect.com/science/article/abs/pii/S174014451630208X">motivation for a thinner shape</a> that damages body image and self esteem.</p> <p>And despite the multiple careers Barbie has held over the decades, research highlights that girls who play with Barbie believe they have <a href="https://link.springer.com/article/10.1007/s11199-014-0347-y">fewer career options than boys</a>. This speaks to the power of toys to reinforce gender stereotypes, roles and expectations, and how Barbie has imported narrow ideals of femininity, girlhood and womanhood into young girls’ lives.</p> <h2>Reinventing a long-established icon</h2> <p>In response to this backlash, Mattel launched a new range of Barbies in 2016 that were promoted as <a href="https://shop.mattel.com/collections/fashion-dolls#filter.ss_filter_tags_subtype=Fashionistas">diverse</a>, representing different body shapes, sizes, hair types and skin tones. This was not without criticism, with “curvy” Barbie still considered thin and dolls named in ways that drew attention foremost to their bodies.</p> <p>From a white, well-dressed, middle-class, girl-next-door with friends of a similar ilk, Barbie has since been marketed as a symbol of diversity and inclusion. To signify the extent of the transformation, Mattel’s executives gave this project the code name “Project Dawn”.</p> <p>Mattel - like many other brands joining the <a href="https://theconversation.com/victorias-secret-joins-the-inclusive-revolution-finally-realizing-diversity-sells-163955">“inclusivity revolution”</a> - knew that diversity sells, and they needed to make their brand relevant for contemporary consumers.</p> <p>Diversity initiatives included a line of <a href="https://shop.mattel.com/pages/barbie-role-models">female role model dolls</a>, promoted as “introducing girls to remarkable women’s stories to show them you can be anything”.</p> <p>Barbie was also given a voice in the form of <a href="https://www.youtube.com/playlist?list=PL5BsRl9zFaeSKIL4XD-pdGHGbJRvkfe8S">Barbie Vlogs</a>, where she expressed her views on issues including depression and the <a href="https://www.bustle.com/p/barbies-vlog-about-the-sorry-reflex-is-the-feminist-pep-talk-all-90s-babies-need-to-hear-9852366">sorry reflex</a>. A gender neutral collection called “creatable world” was added in 2019 to open up gender expression possibilities when playing with Barbies.</p> <p>Such efforts were crucial to undoing missteps of the past, such as a “Teen Talk Barbie” that was programmed to say “<a href="https://www.youtube.com/watch?v=jSL2-rbE9AM">Math class is tough!</a>”, or the compulsory heterosexuality that Barbie has long advanced.</p> <h2>The latest step in Barbie’s transformation</h2> <p>Barbie the film is simply the next step in an evolution to make brand Barbie inclusive. And with a rumoured film budget of $100 million, the supporting marketing machine provides a critical opportunity to reset the Barbie narrative.</p> <p>With Greta Gerwig, acclaimed director of female-led stories such as Little Women and Lady Bird at the helm, and a diverse cast of Barbies of different races, body types, gender identities and sexual preferences, the film and its creators have sought to assure audiences of the film’s feminist leanings.</p> <p>Addressing the complicated history of Barbie is crucial for audiences who grew up and played with the doll and are grappling with introducing her to the next generation of doll consumers.</p> <p>Yet, Robbie Brenner, executive producer of Mattel Films, has explicitly stated that Gerwig’s Barbie is “not a feminist movie”. Indeed, the main character still represents a narrow beauty standard - tall, thin, blonde, white - with diverse characters in place to support her narrative.</p> <p>Which begs the question: are these inclusion initiatives simply emblematic of diversity washing, where the language and symbolism of social justice are hijacked for corporate profit? The soundtrack to selling: why advertising with popular music needs to be pitch perfect

<p><em><a href="https://theconversation.com/profiles/morteza-abolhasani-1346513">Morteza Abolhasani</a>, <a href="https://theconversation.com/institutions/the-open-university-748">The Open University</a></em></p> <p>At some point today, it’s likely that you’ll listen to music. It may be during a commute or school run, while you do some exercise or take some time to relax. Music is all around us – an accessible and popular art form which <a href="https://online.ucpress.edu/mp/article-abstract/22/1/41/62190/Uses-of-Music-in-Everyday-Life?redirectedFrom=fulltext">accompanies our daily lives</a>.</p> <p>Advertisers have long understood the popularity and emotional power of music and used it to sell us things. Much time – and money – is spent on securing the right soundtrack to adverts in a bid to boost sales, such as when Microsoft <a href="https://www.bloomberg.com/news/articles/1999-05-23/sing-a-song-of-selling?leadSource=uverify%20wall">spent a reported US$3 million</a> (£2.4 million) to use The Rolling Stones’ song Start Me Up as part of their advertising campaign for Windows 95.</p> <p>So how do companies choose the right music for their product? And why is it such a valuable ingredient in the mission to make us consume?</p> <p>Research suggests that the specific qualities of music as an art form enhances the science of selling. As one researcher <a href="https://onlinelibrary.wiley.com/doi/10.1002/mar.4220010303">puts it</a>: “Music […] is the catalyst of advertising. It augments pictures and colours words, and often adds a form of energy available through no other source.”</p> <p>Other <a href="https://link.springer.com/chapter/10.1007/978-3-531-18916-1_19">studies have shown</a> how music transports, underlines or amplifies the persuasive message of adverts. Used well, it creates memorable commercials which influence our attitudes to a product or service.</p> <p>Take the visually simple but <a href="https://www.youtube.com/watch?v=J6bGnSEwdKY">compelling advert</a> for Air France, with the soundtrack of Mozart’s Piano Concerto No. 23. It projects grandeur and elegance, in the hope that viewers will associate those qualities with the airline.</p> <figure><iframe src="https://www.youtube.com/embed/J6bGnSEwdKY?wmode=transparent&amp;start=0" width="440" height="260" frameborder="0" allowfullscreen="allowfullscreen"></iframe></figure> <p><a href="https://journals.sagepub.com/doi/pdf/10.1177/1470593117692021">My research</a>, which looked at hundreds of viewer comments about the music used in advertising, suggests it was successful. Air France’s use of a sophisticated piece of classical music created a direct perception of a sophisticated and premium airline.</p> <p>This is supported by other <a href="https://academic.oup.com/edited-volume/38632/chapter-abstract/335307151?redirectedFrom=fulltext">research</a> which suggests that music which matches the main message of an advert has a positive effect on consumer engagement. This alignment, known as “musical congruity”, can result in enhanced attention, a positive emotional response, and improved brand recall, ultimately enhancing the effectiveness of an advert.</p> <h2>Down memory lane</h2> <p>Music is also effective at triggering <a href="https://journals.sagepub.com/doi/abs/10.1177/1470593114521451?journalCode=mtqa">feelings of nostalgia</a>. The extent to which music arouses emotional memories – “musical indexicality” – in adverts creates associations with consumers’ past experiences.</p> <p>The music for <a href="https://www.youtube.com/watch?v=_NwBcCUh24I">an advert</a> for Old Navy inspired <a href="https://journals.sagepub.com/doi/pdf/10.1177/1470593117692021">positive comments</a> based on viewers’ memories. A good choice of music allows businesses to tap into this nostalgia for commercial benefit, and my <a href="https://journals.sagepub.com/doi/pdf/10.1177/1470593117692021">research suggests</a> that music with autobiographical resonance can be particularly effective.</p> <p>Another example of this is when <a href="https://www.youtube.com/results?search_query=pink+moon+vw">Volkswagen used</a> Nick Drake’s <em>Pink Moon</em>.</p> <figure><iframe src="https://www.youtube.com/embed/_-kqUkZnDcM?wmode=transparent&amp;start=0" width="440" height="260" frameborder="0" allowfullscreen="allowfullscreen"></iframe></figure> <p>As one viewer commented: “Rarely do I get sentimental with commercials, but this one takes me back to the time when I was dating my wife and when we were first married. We used to take drives like this in the mountains and I remember looking at her beautiful face in the moonlight. The music is perfect. The sentiment is perfect.”</p> <p>(In this case, the 1999 advert also had a big impact on Nick Drake’s popularity, with album sales <a href="https://www.rollingstone.com/music/music-news/nick-drake-pink-moon-song-volkwagen-commercial-182739/">dramatically increasing</a> after the advert’s release. Drake, who died at the age of 26, never saw commercial success in his lifetime.)</p> <h2>Commercial clash</h2> <p>But using music to advertise products doesn’t always work. For one thing, music can infiltrate the mind, repeat itself continuously and become extremely difficult to dislodge.</p> <p>This is why we can’t get some jingles out of our heads for ages. Involuntary and repetitive exposure to a piece of music can quickly reach the point of annoyance.</p> <p>The use of popular music in advertising can also provoke arguments around <a href="https://journals.library.columbia.edu/index.php/currentmusicology/article/view/5206">the tensions</a> between artistic endeavour and commercialism. Some people believe a work of art should not be used for the pursuit of profit.</p> <p>In fact, the findings of my study on viewer comments showed that consumers sometimes passionately oppose the use of music by revered musicians being used in adverts, as they believe that doing this undermines its aesthetic integrity.</p> <p>For example, Nike’s use of the The Beatles’ song <em>Revolution</em> was seen by some as exploiting John Lennon’s lyrics to sell shoes. It made some Nike wearers so angry that they boycotted the brand.</p> <p>One wrote: “This is disgusting. Shame on Nike for exploiting priceless art. I will never buy another Nike shoe again.” Another said: “John didn’t mean change the brand of your trainers!”</p> <p>So advertisers need to be careful. For while the right choice of music can attract customers, boost sales, and inspire brand loyalty, the wrong choice can create something of a backlash. For many people, music is precious, and using it as a marketing tool does not always have harmonious results.<!-- Below is The Conversation's page counter tag. The Devil Wears Prada iconic townhouse up for grabs

<p dir="ltr">This multi million-dollar house is nothing short of iconic.</p> <p dir="ltr">The Upper East Side townhouse where fictional magazine editor Miranda Priestly resided in David Frankel’s groundbreaking film The Devil Wears Prada has hit the market.</p> <p dir="ltr">Unsurprisingly, the home of the glamorous Runway editor-in-chief, rumoured to be based on Vogue’s Anna Wintour is priced at an eye-watering $40 million. </p> <p dir="ltr">Fans of the beloved 2006 film are sure to recognise the seven-bedroom, six-level home’s grand entrance and spiral staircase as Anne Hathaway’s character Andrea Sachs delivered a mock-up of Runway magazines to Meryl Streep’s character, Priestly in the film. </p> <p dir="ltr">But the infamous staircase also appears on the set of another fictional Upper East Side world.</p> <p dir="ltr">The stairwell briefly appears in the teen drama Gossip Girl’s final episode, for the wedding of Penn Badgley's character Dan and Blake Lively's Serena.</p> <p dir="ltr">Modlin Group boss Adam D. Murder charge levelled at children's book author

<p>Author Kouri Richins wrote a children’s book on grief following the death of her husband in 2022. She is now being charged with his murder.</p> <p>Richins was arrested on May 7 in Utah and is accused of charging documents of poisoning her husband with a lethal dose of fentanyl at their home in Kamas, a small mountain town near Park City.</p> <p>Prosecutors allege Richins called authorities in the middle of the night in March 2022 to report that her husband, Eric Richins, was “cold to the touch”.</p> <p>The mum-of-three told authorities she had made her husband a mixed vodka drink to celebrate him selling a home and then went to soothe one of their children in their bedroom. She later returned and found her husband unresponsive, which prompted her to call 911.</p> <p>A medical examiner later found five times the lethal dosage of fentanyl in his system.</p> <p>Additionally, Richins is facing charges involving the alleged possession of GHB - a narcolepsy drug typically used in recreational settings, including at dance clubs.</p> <p>The charges, which are based on officers’ interactions with Richins that evening and the account of an “unnamed acquaintance” who claimed to have sold her the fentanyl, come two months after Richins appeared on local television to promote Are You With Me, a picture book she wrote to help children cope with the death of a loved one.</p> <p>For a segment called Good Things Utah, Richins referred to her husband’s death as unexpected and explained how it sent her and her three boys spiralling. In terms of children, she said, grieving was about “making sure that their spirit is always alive in your home”.</p> <p>“It’s ... explaining to my kid just because he’s not present here with us physically, doesn’t mean his presence isn’t here with us,” she told the reporters, who commended her for being an amazing mother.</p> <p>Richins’ lawyer, Sky Lazaro, declined to comment on the charges.</p> <p><em>Image credit: Instagram</em></p>

5 negotiation tactics to grab crazy property deals in a slowing market

<p>Rising interest rates have started to put the handbrakes on Australia’s runaway property market, and that’s good news for homebuyers who are now in a far stronger position to negotiate on a property than they have been over the last few years.</p> <p>One of the most apparent advantages for buyers in the current market is the reduced levels of competition. Fewer buyers mean that prices aren’t being driven higher, and if you’re a good negotiator, it’s possible to swoop in and find yourself a bargain.</p> <p>If you’re new to negotiating for property or unsure where to start, here are five tactics that will help you achieve a strong result at the negotiating table.</p> <ol> <li><strong>Know the market</strong></li> </ol> <p>You can’t succeed in a negotiation if you don’t know the value of the asset that you’re trying to buy in the first place. That’s why any good negotiator will always start by doing their research. You need to know the market better than your competition and don’t get caught up in any hype or opinions from a sales agent.</p> <p>Start by finding what comparable properties are selling for in the market. Look for the last three months of sales around your property. The sales should be of similar property types, sizes, ages, and land components. Another good way to get an idea of the price is to speak with local agents in the area. When you have a fair market value, you then know your “walk away price,” and you won’t find yourself getting emotional and overbidding.</p> <ol start="2"> <li><strong>Understand the vendor’s motivations</strong></li> </ol> <p>In any negotiation, there is a saying that whoever needs the deal least will likely be the one that comes out on top. When looking at potential properties to buy, you can be the world’s best negotiator, but if the vendor doesn’t need to sell, they will likely either wait for their price or walk away.</p> <p>Whenever you start looking at a property, try to ascertain as much information about the vendor as possible. That will give you an understanding of how motivated they are to sell, which will then impact how much you initially want to offer.</p> <ol start="3"> <li><strong>Be the strong bidder, not the highest</strong></li> </ol> <p>In a property transaction, price is just one piece of the puzzle. When a vendor weighs up an offer on their property, they are interested in the price, but the terms can also play a big part.</p> <p>For example, if you’re a cash buyer who can settle quickly, that might be far more appealing to a vendor than a higher offer that needs three months to settle. Similarly, a larger deposit could give a vendor more certainty that the transaction will occur.</p> <p>As a buyer, getting your finances in place ahead of time and then tailoring your terms to suit the vendor might give you an edge in a negotiation even if you’re not the highest bidder. Ultimately, the vendor wants their problem solved, and your job is to find out what it is and then make a strong offer that addresses those immediate needs.</p> <p>If you are ever tempted to make an unconditional offer, be sure you’ve done extensive due diligence and can secure finance, as there could be significant costs if you have to back out of the deal.</p> <ol start="4"> <li><strong>Unique offers</strong></li> </ol> <p>A great way to make your offer seem stronger than it might actually be is to come in with an odd-numbered amount. An offer price of $596,200 instead of $590,000 or $600,000 reflects that you’ve taken the time to do your due diligence, making your offer stand out.</p> <p>Another approach is to make a written offer with a deadline. That way, you can speed up the negotiation process, and it might prevent the sales agent from pitting your bid against another buyer to drive up the price.</p> <ol start="5"> <li><strong>Know the property</strong></li> </ol> <p>It’s critical to clearly understand what you’re buying before entering any negotiation. While you might have done your comparable sales analysis and have an excellent overall picture of what similar properties are selling for, you still need to investigate this particular property.</p> <p>Several things can impact the property’s value, which can help you negotiate. For example, if an awkward tenant occupies the property, it will be less appealing to many homebuyers, which you can use to your advantage. There may also be issues with the property, such as problematic zoning, service locations, or even large trees that can alter its value.</p> <p>The most obvious factor to consider is the state of the property and whether it needs renovation or repairs. In the current market, homebuyers are less interested in buying a property that needs work due to the cost of materials and difficulty finding tradespeople. That will give you a strong starting point to negotiate around the price.</p> <p>While getting a great deal is essential, it’s crucial not to compromise on the property’s quality. Quality is more important than a bargain, and a property’s performance will ultimately determine its value.</p> <p>A slowing real estate market presents an opportunity for buyers to negotiate and secure a great property deal. Remote Scottish island hits the market

<p>If you’ve ever dreamt of escaping the rat race and living a life of complete isolation, then look no further.</p> <p>A remote island situated off the southern coast of Scotland, Carlocco Island is up for sale, priced at offers over £150,000 ($A280,317).</p> <p>“There’s still a very romantic sentiment attached to owning your very own Scottish private island, where you can escape the hustle and bustle of everyday life and enjoy some peace and tranquillity in the most beautiful scenery around,” Aaron Edgar of Galbraith Group, the agent handling the sale, said in a statement.</p> <p>The nearest town is almost 10km away with the closest train station Dumfries an hour bus ride from that town. London is more than 563km away with Edinburgh over 160km away.</p> <p>With lush green grass and rocky outcrops reaching the sea, the island covers an area of around 10 hectares, but there are no buildings, only a flood pond providing water to livestock and wildlife in the colder months.</p> <p>According to the listing, no one has ever applied for permission to build on the island, so it would be up to the buyer to investigate any development possibilities with local authorities.</p> <p>At low tide, the island can be reached on foot, by tractor or quad bike. As for the rest of the time, a boat is required for travel, with a pebble beach for them to be anchored, “the perfect base to explore the island, partake in some cold water swimming…and enjoy a waterside picnic,” Edgar said.</p> <p>The island sits in a Site of Special Scientific Interest, an area in the UK defined as of particular interest due to the rare species of fauna and flora it’s home to, and is also a shelter for all types of wildlife, including great black-backed gulls, and rare plants like rock sea lavenders and fragrant orchids.</p> <p>Mr Edgar expects a lot of interest in the unique property, “We have witnessed strong demand from domestic and international parties for entire private islands, having handled the sale of several in Scotland,” he said.</p> <p><em>Image credit: Galbraith Group</em></p>

Will AI ever reach human-level intelligence? We asked 5 experts

<p>Artificial intelligence has changed form in recent years.</p> <p>What started in the public eye as a burgeoning field with promising (yet largely benign) applications, has snowballed into a <a href="https://www.grandviewresearch.com/industry-analysis/artificial-intelligence-ai-market">more than US$100 billion</a> industry where the heavy hitters – Microsoft, Google and OpenAI, to name a few – seem <a href="https://theconversation.com/bard-bing-and-baidu-how-big-techs-ai-race-will-transform-search-and-all-of-computing-199501">intent on out-competing</a> one another.</p> <p>The result has been increasingly sophisticated large language models, often <a href="https://theconversation.com/everyones-having-a-field-day-with-chatgpt-but-nobody-knows-how-it-actually-works-196378">released in haste</a> and without adequate testing and oversight. </p> <p>These models can do much of what a human can, and in many cases do it better. They can beat us at <a href="https://theconversation.com/an-ai-named-cicero-can-beat-humans-in-diplomacy-a-complex-alliance-building-game-heres-why-thats-a-big-deal-195208">advanced strategy games</a>, generate <a href="https://theconversation.com/ai-art-is-everywhere-right-now-even-experts-dont-know-what-it-will-mean-189800">incredible art</a>, <a href="https://theconversation.com/breast-cancer-diagnosis-by-ai-now-as-good-as-human-experts-115487">diagnose cancers</a> and compose music.</p> <p>There’s no doubt AI systems appear to be “intelligent” to some extent. But could they ever be as intelligent as humans? </p> <p>There’s a term for this: artificial general intelligence (AGI). Although it’s a broad concept, for simplicity you can think of AGI as the point at which AI acquires human-like generalised cognitive capabilities. In other words, it’s the point where AI can tackle any intellectual task a human can.</p> <p>AGI isn’t here yet; current AI models are held back by a lack of certain human traits such as true creativity and emotional awareness. </p> <p>We asked five experts if they think AI will ever reach AGI, and five out of five said yes.</p> <p>But there are subtle differences in how they approach the question. From their responses, more questions emerge. When might we achieve AGI? Will it go on to surpass humans? And what constitutes “intelligence”, anyway? </p> <p>Here are their detailed responses. </p> <p><strong>Paul Formosa: AI and Philosophy of Technology</strong></p> <p>AI has already achieved and surpassed human intelligence in many tasks. It can beat us at strategy games such as Go, chess, StarCraft and Diplomacy, outperform us on many <a href="https://www.nature.com/articles/s41467-022-34591-0" target="_blank" rel="noopener">language performance</a>benchmarks, and write <a href="https://www.theatlantic.com/technology/archive/2022/12/chatgpt-ai-writing-college-student-essays/672371/" target="_blank" rel="noopener">passable undergraduate</a> university essays. </p> <p>Of course, it can also make things up, or “hallucinate”, and get things wrong – but so can humans (although not in the same ways). </p> <p>Given a long enough timescale, it seems likely AI will achieve AGI, or “human-level intelligence”. That is, it will have achieved proficiency across enough of the interconnected domains of intelligence humans possess. Still, some may worry that – despite AI achievements so far – AI will not really be “intelligent” because it doesn’t (or can’t) understand what it’s doing, since it isn’t conscious. </p> <p>However, the rise of AI suggests we can have intelligence without consciousness, because intelligence can be understood in functional terms. An intelligent entity can do intelligent things such as learn, reason, write essays, or use tools. </p> <p>The AIs we create may never have consciousness, but they are increasingly able to do intelligent things. In some cases, they already do them at a level beyond us, which is a trend that will likely continue.</p> <p><strong>Christina Maher: Computational Neuroscience and Biomedical Engineering</strong></p> <p>AI will achieve human-level intelligence, but perhaps not anytime soon. Human-level intelligence allows us to reason, solve problems and make decisions. It requires many cognitive abilities including adaptability, social intelligence and learning from experience. </p> <p>AI already ticks many of these boxes. What’s left is for AI models to learn inherent human traits such as critical reasoning, and understanding what emotion is and which events might prompt it. </p> <p>As humans, we learn and experience these traits from the moment we’re born. Our first experience of “happiness” is too early for us to even remember. We also learn critical reasoning and emotional regulation throughout childhood, and develop a sense of our “emotions” as we interact with and experience the world around us. Importantly, it can take many years for the human brain to develop such intelligence. </p> <p>AI hasn’t acquired these capabilities yet. But if humans can learn these traits, AI probably can too – and maybe at an even faster rate. We are still discovering how AI models should be built, trained, and interacted with in order to develop such traits in them. Really, the big question is not if AI will achieve human-level intelligence, but when – and how.</p> <p><strong>Seyedali Mirjalili: AI and Swarm Intelligence</strong></p> <p>I believe AI will surpass human intelligence. Why? The past offers insights we can't ignore. A lot of people believed tasks such as playing computer games, image recognition and content creation (among others) could only be done by humans – but technological advancement proved otherwise. </p> <p>Today the rapid advancement and adoption of AI algorithms, in conjunction with an abundance of data and computational resources, has led to a level of intelligence and automation previously unimaginable. If we follow the same trajectory, having more generalised AI is no longer a possibility, but a certainty of the future. </p> <p>It is just a matter of time. AI has advanced significantly, but not yet in tasks requiring intuition, empathy and creativity, for example. But breakthroughs in algorithms will allow this. </p> <p>Moreover, once AI systems achieve such human-like cognitive abilities, there will be a snowball effect and AI systems will be able to improve themselves with minimal to no human involvement. This kind of “automation of intelligence” will profoundly change the world. </p> <p>Artificial general intelligence remains a significant challenge, and there are ethical and societal implications that must be addressed very carefully as we continue to advance towards it.</p> <p><strong>Dana Rezazadegan: AI and Data Science</strong></p> <p>Yes, AI is going to get as smart as humans in many ways – but exactly how smart it gets will be decided largely by advancements in <a href="https://thequantuminsider.com/2020/01/23/four-ways-quantum-computing-will-change-artificial-intelligence-forever/" target="_blank" rel="noopener">quantum computing</a>. </p> <p>Human intelligence isn’t as simple as knowing facts. It has several aspects such as creativity, emotional intelligence and intuition, which current AI models can mimic, but can’t match. That said, AI has advanced massively and this trend will continue. </p> <p>Current models are limited by relatively small and biased training datasets, as well as limited computational power. The emergence of quantum computing will transform AI’s capabilities. With quantum-enhanced AI, we’ll be able to feed AI models multiple massive datasets that are comparable to humans’ natural multi-modal data collection achieved through interacting with the world. These models will be able to maintain fast and accurate analyses. </p> <p>Having an advanced version of continual learning should lead to the development of highly sophisticated AI systems which, after a certain point, will be able to improve themselves without human input. </p> <p>As such, AI algorithms running on stable quantum computers have a high chance of reaching something similar to generalised human intelligence – even if they don’t necessarily match every aspect of human intelligence as we know it.</p> <p><strong>Marcel Scharth: Machine Learning and AI Alignment</strong></p> <p>I think it’s likely AGI will one day become a reality, although the timeline remains highly uncertain. If AGI is developed, then surpassing human-level intelligence seems inevitable. </p> <p>Humans themselves are proof that highly flexible and adaptable intelligence is allowed by the laws of physics. There’s no <a href="https://en.wikipedia.org/wiki/Church%E2%80%93Turing_thesis" target="_blank" rel="noopener">fundamental reason</a> we should believe that machines are, in principle, incapable of performing the computations necessary to achieve human-like problem solving abilities. </p> <p>Furthermore, AI has <a href="https://philarchive.org/rec/SOTAOA" target="_blank" rel="noopener">distinct advantages</a> over humans, such as better speed and memory capacity, fewer physical constraints, and the potential for more rationality and recursive self-improvement. As computational power grows, AI systems will eventually surpass the human brain’s computational capacity. </p> <p>Our primary challenge then is to gain a better understanding of intelligence itself, and knowledge on how to build AGI. Present-day AI systems have many limitations and are nowhere near being able to master the different domains that would characterise AGI. The path to AGI will likely require unpredictable breakthroughs and innovations. </p> <p>The median predicted date for AGI on <a href="https://www.metaculus.com/questions/5121/date-of-artificial-general-intelligence/" target="_blank" rel="noopener">Metaculus</a>, a well-regarded forecasting platform, is 2032. To me, this seems too optimistic. A 2022 <a href="https://aiimpacts.org/2022-expert-survey-on-progress-in-ai/" target="_blank" rel="noopener">expert survey</a> estimated a 50% chance of us achieving human-level AI by 2059. When hosting mega-events like FIFA, cities market themselves at the expense of the most vulnerable

<p>Few events capture the attention of the globe like the Men’s FIFA World Cup — in 2018, the event boasted a viewership of <a href="https://www.fifa.com/tournaments/mens/worldcup/2018russia/media-releases/more-than-half-the-world-watched-record-breaking-2018-world-cup">3.5 billion people</a>. Yet, despite the enormous popularity of the World Cup, <a href="https://www.aljazeera.com/sports/2022/11/17/do-host-countries-make-money-from-the-world-cup">host cities and countries invariably lose money</a> on the event itself, with FIFA capturing most of the profits despite its non-profit status.</p> <p>The calculus of host cities is based on the hope that successfully hosting a World Cup (or Olympics) will significantly enhance a city’s urban brand and ultimately lead to long-term increases in tourism and foreign direct investment.</p> <p>In other words, the argument is that a successful stint as a host city will identify that city as “<a href="https://www.jstor.org/stable/40643231">world-class</a>” and change its economic fortunes. This justification, at least from an economic point of view, relies on <a href="https://doi.org/10.1080/02614360500504628">some pretty fuzzy math and long-term forecasting that rarely gets audited</a>.</p> <p>I attended the 2010 World Cup in South Africa to study how various communities attempted to have their voices heard and needs met through the planning process for that event. I continue to research how hosting large-scale events intersect with other trends in global and local urbanization.</p> <p><strong>Urban branding</strong></p> <p>This mission of improving one’s urban brand to attract tourist and foreign investment leads cities to focus their attention to the perceived needs. Or, more precisely, the perceived desires of potential tourists and investors, as opposed to the needs and desires of the people who already live, work and play in these cities.</p> <p>This shift in focus is part of larger trends of cities becoming <a href="https://doi.org/10.1080/04353684.1989.11879583">increasingly entrepreneurial in our globalized world</a>.</p> <p>And to this end, host cities pursue a fairly predictable path to demonstrate their world-classness. However, the particular interventions that each city makes to create this type of world- class city are unique to their particular context.</p> <p>Unfailingly, cities significantly increase policing, both in the sheer numbers of police, military and surveillance measures as well as the powers afforded to the police and military. These powers are used to police undesirable activities and individuals — those activities and people deemed incommensurate with the desired world-class brand.</p> <p>Youth, the unhoused or precariously housed, street vendors and racialized individuals <a href="https://doi.org/10.1080/17430437.2010.520938">experience the brunt of these increases</a>.</p> <p>In South Africa in 2010, FIFA courts were established to exact “<a href="https://www.nytimes.com/2010/06/21/sports/soccer/21iht-wcsoccer.html">swift and severe justice</a>” for crimes committed against tourists and journalists during the 2010 World Cup. In Qatar, there has been <a href="https://www.thestar.com/politics/2022/11/24/lgbtq-and-other-rights-issues-at-world-cup-a-huge-blemish-on-fifa-hall-of-famer.html">targeted policing of LGBTQ+ people and allies</a>.</p> <p>Additionally, the quest for this type of world-class-city brand also leads to uneven investment and under-investment as cities are forced to make choices about how to invest their municipal budgets.</p> <p>Tourist areas <a href="https://www.jstor.org/stable/25765282">see significant infrastructure investments while those off the tourist map are often ignored</a>. In the process, it exposes the already existing cracks in the system and exacerbates existing inequalities.</p> <p>The World Cup did not create the labour system and working conditions of temporary migrant workers in Doha. However, both the magnitude and speed of construction to meet hosting needs undoubtedly ramped up the exploitation of the system, leading to <a href="https://www.theguardian.com/global-development/2021/feb/23/revealed-migrant-worker-deaths-qatar-fifa-world-cup-2022">thousands of worker deaths</a>.</p> <p>We need to reframe how a world-class city is defined to one that is more liveable, sustainable and just. Do tenancy reforms to protect renters cause landlords to exit the market?

<p>More Australians are <a href="https://theconversation.com/wealthy-landlords-and-more-sharehousing-how-the-rental-sector-is-changing-94394">renting their housing longer</a> than in the past. But they have relatively little legal security against rent increases and evictions compared to <a href="https://theconversation.com/what-australia-can-learn-from-overseas-about-the-future-of-rental-housing-90401">tenants in other countries</a>. When state governments suggest stronger protections for tenants, landlords and real estate agents <a href="https://www.reiq.com/articles/reiq-concerned-rental-reforms-unravel-rights-of-property-owners/">claim it will cause disinvestment</a> from the sector, increasing pressure on already tight rental markets.</p> <p>In <a href="https://www.ahuri.edu.au/research/final-reports/391">research</a> for the Australian Housing and Urban Research Institute (<a href="https://www.ahuri.edu.au/about">AHURI</a>), published today, we put the “disinvestment” claim to the test. We looked at the impacts of tenancy reforms in New South Wales and Victoria on rental property records over 20 years, as well as surveying hundreds of property investors. We found no evidence to support this claim.</p> <p>We did find a high rate of turnover as properties enter and leave the sector. This happened regardless of tenancy law reforms. It’s a major cause of the unsettled nature of private rental housing for tenants.</p> <p>We suggest that if substantial tenancy reforms did cause less committed landlords to exit the sector, that might not be a bad thing.</p> <blockquote class="twitter-tweet"> <p dir="ltr" lang="en">A tenancy law expert says it could be illegal in several states, while tenants’ advocates say it preys on vulnerable renters during Australia’s housing crisis. <a href="https://t.co/hQEdS80a3h">https://t.co/hQEdS80a3h</a> (via <a href="https://twitter.com/abcnews?ref_src=twsrc%5Etfw">@abcnews</a>)</p> <p>— ABC Australia (@ABCaustralia) <a href="https://twitter.com/ABCaustralia/status/1587927668846399488?ref_src=twsrc%5Etfw">November 2, 2022</a></p></blockquote> <p><strong>How did we test the disinvestment claim?</strong></p> <p>We analysed records of all rental bond lodgements and refunds in Sydney and Melbourne from 2000 to 2020. From these records we can see properties entering the rental sector for the first time (investment) and exiting the sector (disinvestment).</p> <p>We looked for changes in trends in property entries and exits around two law reform episodes: when the 2010 NSW Residential Tenancies Act took effect, and the start of a tenancy law reform review in Victoria in 2015.</p> <p>We found no evidence the NSW reforms affected property entries (investment). And property exits (disinvestment) were slightly reduced – that is, fewer properties exited than expected.</p> <p>In Victoria, we found property entries reduced slightly when the law reform review started – perhaps a sign of investors pausing for “due diligence”. We saw no effect on property exits.</p> <p>So in neither state did we find evidence of a disinvestment effect.</p> <p>We also surveyed 970 current and previous property investors, and got a similar picture. When deciding to invest, investors said prospective rental income and capital gains were the most important considerations, but tenancy laws were important too.</p> <p>On the other hand, tenancy laws were the least-cited reason for disposing of properties. Many more investors said they did it because they judged it a good time to sell and realise gains, or they wanted money for other purposes, or because the investment was not paying as they had hoped.</p> <p><strong>A state of constant churn</strong></p> <p>Our research also gives new insights into the private rental sector, which <a href="https://www.housingdata.gov.au/">has been growing</a> relative to owner-occupied and social housing.</p> <p>Small-holding “mum and dad” landlords dominate the sector. Some 70% of landlords own a single property. Multiple-property owners own more properties in total, but still relatively small numbers (rarely more than ten) compared to corporate landlords in other countries who have tens of thousands of properties, or even more. Australia now has some large corporate landlords, but their properties are a tiny fraction of the total rental stock.</p> <p>Beneath its gradual growth and persistent small-holding pattern, the private rental sector is dynamic. Properties enter and exit the sector very frequently. And more than 25% of tenancy terminations happen when the property exits the sector.</p> <p>Our investor survey also shows the sector’s dynamism. Many investors made repeated investments, owning multiple properties and some interstate. They indicated strong interest in <a href="https://theconversation.com/ever-wondered-how-many-airbnbs-australia-has-and-where-they-all-are-we-have-the-answers-129003">short-term letting</a>, such as Airbnb, and significant minorities had used their properties for purposes other than rental housing.</p> <p>Australia’s rental housing interacts closely with other sectors, particularly owner-occupied housing, as houses and strata-titled apartments trade between the sectors. The tax-subsidised property prices paid by owner-occupiers heavily influence investors’ gains and decision-making. Rental is also increasingly integrated with tourism, through governments’ <a href="https://theconversation.com/who-wins-and-who-loses-when-platforms-like-airbnb-disrupt-housing-and-how-do-you-regulate-it-106234">permissive approach to short-term letting</a>.</p> <p>In short, the Australian rental sector is built for investing and disinvesting. As properties churn in and out of rental, renters are churned in and out of housing.</p> <p>This presents problems for tenants.</p> <p><strong>A new agenda for tenancy law reform</strong></p> <p>Australian residential tenancies law has accommodated the long-term growth of the rental sector and its dynamic character. With no licensing or training requirements, it’s easy for landlords to enter the sector. It’s also easy to exit by terminating tenancies, on grounds they want to use a property for other purposes, or even without grounds in many cases.</p> <p>Over the years tenancy law reform has fixed some problem areas, but with virtually no national co-ordination. Laws are increasingly inconsistent on important topics, such as tenants’ security (for example, some states have restricted, but not eliminated, no-grounds terminations), minimum standards and domestic violence. Reforms have overlooked significant problem areas, such as steep rent increases and landlords’ liability for defective premises.</p> <blockquote class="twitter-tweet"> <p dir="ltr" lang="en">Works for Australia too. The focus should be on the rights of tenants to affordable housing, in decent condition, that supports autonomy and secure occupancy.</p> <p>Where landlords say it is too difficult and they will disinvest, this should not be taken as a threat. Indeed, it would be a good thing if the speculative, incapable and unwilling investors exited the sector. Multi-coloured plants are suddenly a home decor ‘must-have’. Here’s how to keep them alive

<p>Fads and fashion have always influenced the plants we keep. And so it is with variegated plants, which have become <a href="https://thatplantylife.com/affordable-and-gorgeous-variegated-houseplants/">very popular</a>with indoor plant enthusiasts these days.</p> <p>Variegated plants possess multiple colours – typically on their leaves, but in some cases on stems, flowers and fruit. Their patterns include stripes, dots, edges and patches. They’re usually green with either white or yellow, but can also feature red, pink, silver and other colours.</p> <p>Variegated plants can divide opinion. I recall a great aunt telling me many years ago of her great fondness for the variegated Aspidistra elatior growing her garden. But I’ve also heard gardeners and garden designers dismiss variegated foliage because it didn’t fit with their design or colour themes.</p> <p>Now, it seems indoor variegated plants are considered a “<a href="https://www.apartmenttherapy.com/variegated-plant-care-tips-36878935">must-have</a>” home decor accessory. But before you rush out and buy one, make sure you know how to keep it happy.</p> <h2>Understanding variegated plants</h2> <p>Most plant species are entirely green but occasionally a variegated individual arises. Some catch the eye of a dedicated plant collector or nursery worker and become a popular variety.</p> <p>Plant variegation can occur for several reasons.</p> <p>In some plants, such as the flowers of tulips, it’s due to a <a href="https://www.britannica.com/story/tulip-mania-how-a-plant-virus-fueled-a-speculative-frenzy">viral infection</a>. The resulting streaks of different colours may be cursed or valued depending on the aesthetic effect.</p> <p>Others plants, such as those in the genus <a href="https://www.rbgsyd.nsw.gov.au/Stories/2019/Coleus-back-in-the-name-game">coleus</a>, are naturally patterned. Groups of cells produce different colour combinations, causing leaves to grow with attractive markings.</p> <p>Plant variegations can also arise from genetic mutation.</p> <p>When growing variegated plants, it’s important to understand how the various colours affect the way it functions.</p> <p>The green part of plants contains chlorophyll, a pigment essential for photosynthesis. (Photosynthesis, of course, is the process by which the leaves convert sunlight into oxygen and carbohydrate that provides energy for plants to grow.) </p> <p>In variegated plants, white parts of leaves do not contain chlorophyll and so do not photosynthesise. </p> <p>Yellow parts of leaves can help send energy to the chlorophyll, but can’t perform photosynthesis on their own. The same goes for some red, orange and pink patches of tissue.</p> <p>But all cells in the leaf – green or not – use the plant’s energy. That means variegated plants are less efficient energy producers than their all-green counterparts, which causes them to grow more slowly.</p> <p>Some plants have mutated into <a href="https://www.chicagobotanic.org/blog/how_to/science_activity_albino_plants">albinos</a> containing no chlorophyll. These normally die within a few days or weeks of germination.</p> <h2>Caring for your plant indoors</h2> <p>It’s no coincidence many popular indoor plants – such as coleus, philodendrons, monsteras, dracaenas and calatheas – are variegated. Because they’re usually far less vigorous than all-green versions of the species, they won’t be pushing against the ceiling within weeks. </p> <p>The decorative colour and pattern of a variegated indoor plant is an added bonus.</p> <p>Variegated plants can take longer than others to reach a size considered appropriate for sale at a nursery, so may be comparatively more expensive. But there are ways to protect your variegated investment.</p> <p>First, watch out for “reversion”. This can occur when a variegated plant sends up an all-green shoot. The shoot will grow fast compared to the variegated parts and can eventually take over, causing the whole plant to revert to green. </p> <p>To avoid this, vigilantly remove any green shoots before they get big.</p> <p>You don’t want variegated plants quickly outgrowing their space, but remember they’re low on chlorophyll and so need good light.</p> <p>And like any indoor plant, ensure its leaves are kept free of fine dust and you don’t give it too much, or too little, water.</p> <h2>Variegated plants in the garden</h2> <p>The popularity of indoor variegated plants will almost certainly lead to greater use outdoors.</p> <p>Their slow-growing nature means outdoor variegated plants are usually much less likely to be “weedy” and spread where they’re not wanted. </p> <p>This can be an advantage if you’ve avoided planting a species because it will take over the garden. The variegated versions of <a href="https://www.plantmark.com.au/pittosporum-eugenioides-variegata">pittosporum</a>, ficus and <a href="https://www.rhs.org.uk/plants/57250/nerium-oleander-variegatum-(v)/details">nerium oleander</a>, for example, are far less intent on global domination than their all-green counterparts.</p> <p>When planting a variegated plant outdoors, watch that it doesn’t become shaded by other quicker-growing plants. Many variegated plants already struggle to photosynthesise sufficiently. A bit of extra shade can damage or even kill them.</p> <p>So ensure they get enough light – and every so often give them a hand by trimming back nearby plants.</p> <h2>Growing with flying colours</h2> <p>Variegated plants are having their moment in the sun. Building and construction emissions and energy use reaches record levels

<p>Despite improvements in energy efficiency, greenhouse pollution levels from the building and construction sector reached an all-time high in 2021.</p> <p>A new report on the building and construction sector by the United Nations Environment Programme released for COP27 found energy demand in buildings – for heating, cooling, lighting and equipment – increased by 4% from 2020 levels. As a result, the sector’s emissions increased 5% compared to 2020.</p> <p>While the increase partly reflects a re-bound in building and construction activities after the pandemic, energy and emissions levels were also above 2019 levels.</p> <p>This is significant because the sector accounts for around a third of total energy demand, the report says.</p> <p>The UN Secretary General Antonio Guterres told the opening forum of COP27 that the future of the planet is in our hands. “…and the clock is ticking. We are in the fight of our lives. And we are losing. Greenhouse gas emissions keep growing. Global temperatures keep rising. And our planet is fast approaching tipping points that will make climate chaos irreversible.</p> <p>“We are on a highway to climate hell with our foot still on the accelerator. “</p> <p>With the release of the report, UNEP executive director, Inger Andersen added: “If we do not rapidly cut emissions in line with the Paris Agreement, we will be in deeper trouble.”</p> <p>The UNEP report argues investments in energy efficiency must be sustained in the face of growing crises – such as the war in Ukraine and rising energy and living costs – to help with reducing energy demand, avoiding greenhouse gas pollution and reducing energy cost volatility.</p> <p>“The solution may lie in governments directing relief towards low and zero-carbon building investment activities through financial and non-financial incentives,” Andersen says.</p> <p>Also critical to reducing the sector’s emissions are including buildings in climate pledges under the Paris Agreement – known as Nationally Determined Contributions – and mandatory building energy codes.</p> <p>The report’s recommendations include: building coalitions of stakeholders in support of sustainable buildings, governments introducing mandatory building energy codes and government policies, increasing investment in energy efficiency and commitments from industry.</p> <p><img id="cosmos-post-tracker" style="opacity: 0; height: 1px!important; width: 1px!important; border: 0!important; position: absolute!important; z-index: -1!important;" src="https://syndication.cosmosmagazine.com/?id=222598&amp;title=Building+and+construction+emissions+and+energy+use+reaches+record+levels" width="1" height="1" /></p> <div id="contributors"> <p><em><a href="https://cosmosmagazine.com/earth/building-emissions-reach-record-levels/" target="_blank" rel="noopener">This article</a> was originally published on Cosmos Magazine and was written by Petra Stock. </em></p> <p><em>Image: Getty Images</em></p> </div>

Drop that bass (below the level of human hearing) to get bodies on the dance floor moving

<p>People dance nearly 12% more when music includes very low frequency bass but researchers have found that it may be the sounds we don’t hear that gets our toes tapping.</p> <p>This is interesting news for those who’ve had an experience at a party, celebration or club when the music’s groove just isn’t making your body move and who might be tempted to reach for the nearest beverage to lubricate our joints.</p> <p>But maybe there’s a solution which is more subtle – and less liable to cause headaches the next day…</p> <p>It seems, as Meghan Trainor correctly observed in 2014, that it really is “All About That Bass.”</p> <p>Now, it is no revelation that bass-driven music is good for a boogie. Trainor certainly wasn’t the first to discover this critical component of the rhythm section.</p> <p>Researchers from Canada and Germany turned a live electronic music concert into a lab study, to find out how different qualities of music influence the body. Their results are <a href="https://doi.org/10.1016/j.cub.2022.09.035%20" target="_blank" rel="noreferrer noopener">published</a> in <em>Current Biology</em>.</p> <p>The researchers introduced over speakers levels of bass below human hearing levels. This super low pitch infrasound is made up of wavelengths of sound too long for our ears to pick up. Infrasound is common in whale song and other parts of the animal and natural world.</p> <p>Monitoring the crowd’s movements, the scientists found that people danced 11.8% more when the very low frequency bass was present.</p> <p>“I’m trained as a drummer, and most of my research career has been focused on the rhythmic aspects of music and how they make us move,” says first author Daniel Cameron, a neuroscientist from Canada’s McMaster University. “Music is a biological curiosity – it doesn’t reproduce us, it doesn’t feed us, and it doesn’t shelter us, so why do humans like it and why do they like to move to it?”</p> <p>Cameron and colleagues treated participants in the study to a 45-minute live set by electronic musical duo Orphx at LIVELab, a research theatre at the University.</p> <p>Donning motion-sensing headbands, the concert-goers’ dance moves were monitored. They were also asked to fill out survey forms before and after to ensure they didn’t detect the infrasound, to measure their enjoyment, and examine how the music felt physically.</p> <p>Turning the ultra-low bass playing speakers on and off every two minutes, the researchers found movement increased by 12% when the speakers were on.</p> <p>Vibrations experienced through touch and interactions between the inner ear and brain are closely linked to the motor system.</p> <p>The researchers theorise that there is a neurological link between these physiological processes and music. They believe that our anatomy can pick up on low frequencies, affecting our perception of “groove”, spontaneous movement and rhythm.</p> <p>Cameron suggests that the super-low frequencies may influence the vestibular system which controls body position and movement through the inner ear.</p> <p>“Very low frequencies may also affect vestibular sensitivity, adding to people’s experience of movement. Nailing down the brain mechanisms involved will require looking the effects of low frequencies on the vestibular, tactile, and auditory pathways,” says Cameron.</p> <p><em>Image credits: Getty Images</em></p> <p><em><!-- Start of tracking content syndication. Willie Nelson’s former Tennessee home hits the market

<p dir="ltr">The former home of country music legend Willie Nelson has been listed for sale, and the folklore surrounding it is just as interesting as the home itself.</p> <p dir="ltr">According to property records, the 150-acre property and its pastures, woods, trails, and cabin have been owned by just two people, including the <em>Georgia On My Mind</em> singer.</p> <p dir="ltr">“From what we can find from tax records, there have only been two owners. One is the current seller and different members of that family. And the other is Willie Nelson,” Ross Welch, one of the two Zeitlin Sotheby’s International Realty agents representing the property, said.</p> <p dir="ltr">“This was one of the properties that the IRS seized when Willie was not paying taxes.”</p> <p dir="ltr">Before the IRS seized the home in the early 1990s, Nelson lived there from the early 1960s.</p> <p dir="ltr">After settling his tax debt in 1993, the property was returned to the family that had owned it, who then sold it on to the current owners.</p> <p dir="ltr">“From what we have been told and what we’ve seen on tax records, it was seized by the IRS and then the IRS went back to the family that had previously owned it and asked if they wanted to buy it back for pennies on the dollar,” Matt Lawson, the second agent representing the home, explained.</p> <p dir="ltr">Prior to its complicated ownership, Nelson built the property’s rustic log cabin, which features lime and mortar from the property in the shower and fireplace.</p> <p dir="ltr">In 1970, another home on the property caught fire while the singer wasn’t inside, sparking the story in which he rushed home to rescue his beloved guitar Trigger and a pound of marijuana, per <em><a href="https://tasteofcountry.com/willie-nelson-nashville-house-cabin-estate-for-sale-pictures/" target="_blank" rel="noopener">Taste of Country</a></em>.</p> <p dir="ltr">The events described in Nelson’s hit <em>Shotgun Willie</em> also reportedly took place while he lived at the home and earned him the nickname, though Lawson hasn’t found concrete evidence to confirm the stories.</p> <p dir="ltr">“One of the biggest stories that I wish I had concrete proof of is that this is the place where he got the nickname ‘Shotgun Willie,’” he said.</p> <p dir="ltr">“There’s a ton of just wild stories about him out there.”</p> <p dir="ltr">The sprawling property has been listed for $2.5 million ($AUD 3.9 or $NZD 4.3 million).</p> <p><span id="docs-internal-guid-c1a37b8e-7fff-97f7-ca7c-427777b5e5e8"></span></p> <p dir="ltr"><em>Images: @willienelsonofficial (Instagram) / Realtor.com</em></p>

Gwyneth Paltrow’s childhood home hits the market

<p dir="ltr">The childhood home of Gwyneth Paltow in California has been <a href="https://www.compass.com/listing/2020-georgina-avenue-santa-monica-ca-90402/1161644315586325737/" target="_blank" rel="noopener">listed</a> for sale with a hefty price tag of $17.5 million ($NZD 30 million).</p> <p dir="ltr">The six-and-a-half bedroom mansion was first purchased by Paltrow’s parents, actress Blythe Danner and Hollywood director Bruce Paltrow, in 1976 when the Goop founder was about four years old.</p> <p dir="ltr">In 2008, the 109-year-old property was bought by designer Jerome Dahan after Paltrow’s father died from complications of oral cancer and pneumonia.</p> <p dir="ltr">The property, nestled in the upscale neighbourhood Gillette Regent Square in Santa Monica, boasts features that match the luxe nature of its surroundings, including a landscaped tropical oasis for a garden, a Balinese-inspired pool and spa, and a three-car glass showroom that overlooks the pool.</p> <p dir="ltr">Inside the home, the entryway is enclosed in glass and leads to a large living room with a fireplace, a theatre room, a kitchen and a guest bedroom, with an office and three ensuite bathrooms upstairs, including the main bedroom’s dual bathrooms and walk-in closets.</p> <p dir="ltr">The property also includes a two-storey guesthouse that houses a gym, dry sauna, bedroom and office.</p> <p dir="ltr">Following extensive renovations, the property has additions such as solar panels, backup generators, and electronically gated entries.</p> <p dir="ltr">“In a market of overbuilt mansions that are undeniably starting to look and feel the same, 2020 Georgina elevates above the competition offering a bespoke and meticulously crafted experience unlike anything I've seen in Santa Monica,” said Robert Lawrence Edie of Compass Realty, who is managing the sale.</p> <p dir="ltr">Paltrow grew up in the home with her younger brother, Jake Paltrow, and went to school at the nearby Crossroads School for Arts &amp; Sciences.</p> <p dir="ltr">When she was 12, the family moved to a New York City townhouse and she now lives on the West Coast full-time with her husband and two children.</p> <p><span id="docs-internal-guid-e0c6ebde-7fff-5741-9789-ef82639a4dc0"></span></p> <p dir="ltr"><em>Images: @gwynethpaltrow (Instagram) / Compass Realty</em></p>
